The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", "You" and "Your" refers to you, the person accessing this website and accepting the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company, Mindcraft Mental Health. "Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves.

1. Services

Mindcraft Mental Health offers online counselling services to individuals. Our counselling sessions are conducted online using a secure video platform. Our services are suitable for individuals who are under 16 years old with parental consent and individuals over 16 years old. Our services are not suitable for emergencies, and we do not provide crisis counselling. If you are in crisis, please call 911 or go to your nearest emergency room.

2. Fees and Payments

Mindcraft Mental Health charges a fee for our counselling services, which is $80 or $60 if you are an active student. Our fees are subject to change, and we reserve the right to modify our fees at any time. Payment is due on the day of your session. We accept payment through Jane app and Interac e-transfer. Payment details will be provided to you at the time of booking.

3. Confidentiality

We take confidentiality seriously, and we will not disclose any information about you or your counselling sessions to anyone without your written permission. However, there are certain exceptions to this rule, which are mandated by law. We may be required to disclose information about you if we believe that you pose a threat to yourself or others, if we are ordered by a court to disclose information, or if we are legally required to report suspected abuse or neglect of a vulnerable person.

4. Termination of Services

We reserve the right to terminate counselling services at any time, with or without cause.

5. Limitation of Liability

Mindcraft Mental Health will not be liable for any direct, indirect, incidental, special, or consequential damages that may result from your use of our counselling services. We will not be liable for any loss of profits, data, or goodwill, or any other losses that may result from the use of our services.

6. Intellectual Property

All content on Mindcraft Mental Health's website is the property of Mindcraft Mental Health and is protected by copyright law. You may not reproduce, distribute, or otherwise use any of the content on our website without our written permission.

7. Governing Law

These terms and conditions are governed by the laws of the Province of British Columbia. Any dispute arising out of these terms and conditions will be resolved by arbitration in accordance with the rules of the British Columbia International Commercial Arbitration Centre.

9. Preference of Law and Dispute Resolution

Any dispute arising out of or in connection with these Terms shall be resolved exclusively through arbitration in accordance with the rules of the British Columbia International Commercial Arbitration Centre.
